1. Agreement to Terms
By using the Ms Smart Shop mobile application, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the service.
2. Eligibility and Account
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Ordering and Pricing
- All prices are in New Zealand Dollars (NZD) and include GST unless stated otherwise.
- We reserve the right to change prices at any time.
- Total order costs, including delivery fees, will be displayed at checkout before payment is processed.
4. Delivery Services
- Delivery is fulfilled by our third-party logistics partners (e.g., Uber Direct).
- You must provide a valid delivery address within our service area.
- If a delivery is unsuccessful because you are not present or the address is inaccessible, a redelivery fee may apply.
5. Restricted Items (Alcohol/Tobacco)
If your order contains restricted items, you must present a valid New Zealand ID (Driver's License, Passport, or HANZ 18+ card) to the delivery driver. Delivery will be refused without a refund of the delivery fee if valid ID is not provided.
6. Limitation of Liability
To the extent permitted by New Zealand law, MS Smart Shop is not liable for any indirect or consequential loss arising from the use of our service or delivery delays.
7. Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
